Step 2: Agree to the Terms of Agreement

1. These offers are subject to change, including prices quoted over the phone, without notice before customer commitment. Price based on availability of supply at prevailing rates. Prices are updated daily and can be viewed by visiting our website. The price may be increased or decreased before commitment depending on current market conditions, which can and do fluctuate. Committed customer agrees that there shall be no refund made for Price Protection, Fixed prices, fixed gallons or budgets, and agrees to purchase all quantities of heating oil specified in this contract. The price that stands shall be the existing price at the time we receive the executed contract in our office. Non-homeowners and C.O.D. customers may not be eligible for budget programs. This form needs to be returned in it's entirety and should not be cut or deformed in any way.
   
   
2. All fuel oil deliveries for automatic delivery customers shall be delivered on an automatic degree-day delivery basis only. Unscheduled, nonemergency deliveries or top-offs cannot be made under this agreement. Customer agrees to remain on automatic delivery for the duration of this contract. If you are new to automatic delivery, please monitor your tank level for the first three cold weather deliveries to allow our system to accurately calculate your usage. Automatic delivery is not suitable for vacant homes. By enrolling in this program, customer agrees not to purchase fuel from any other company. Minimum delivery is 150 gallons. Customer requests for below minimum deliveries or requests for deliveries before the degree-day schedule will require additional charges. Price is subject to change when gallon usage is exceeded and non C.O.D customers shall remain on automatic delivery unless otherwise notified in writing to suspend automatic delivery.
   
   
3. All fuel oil deliveries for will-call delivery customers shall be delivered on a call-in delivery basis. Customers who monitor tank levels should give at least 48 hours' notice when the tank level reaches one-quarter tank capacity. Emergency and under-minimum deliveries will require additional charges. By enrolling in this program, customer agrees not to purchase fuel from another company. Minimum delivery is 150 gallons. Price is subject to change when contract gallons usage is exceeded and the deliveries shall be billed at our current posted price on the date of delivery.
   
   
4. Customer agrees to consume the total amount of gallons identified in this contract, with consideration given to use of supplemental heat, such as wood or any other means that may affect consumptive use before all contract gallons are established or accepted by the customer. By signing this contract you agree to the gallons specified.
   
   
5. Budget price-protected cap gallons shall be estimated based on previous year's usage. Price is subject to change when contract gallon usage is exceeded and the deliveries shall be billed at our current posted budget price on the date of delivery. All budget customers shall remain on automatic delivery for the duration of this contract. Monthly Budget amounts for non cap customers may be adjusted up or down during the heating season depending on the market conditions at the time of delivery. Budget and budget cap customers agree to make monthly budget payments. Failure to make monthly payments shall result in removal from the budget and additional fees. Monthly budget payments may be reduced to an eight-month schedule if the contract is extended beyond August 31, 2024.
   
   
6. This agreement is exclusive of any applicable taxes and fees.
   
   
7. All service billings must be paid in addition to Budget and Pre-Pay payments.
   
   
8. All Payments must be received by the due date to maintain cap protection. In the event that payment is past due, delivery may be re-billed at the regular market price on the date of delivery for the outstanding balance, and program may be terminated. Participants must have a zero or current balance upon entering into this agreement. All other standard account payment terms will apply on late payments. Cap and Price Protection fees are nonrefundable and will be included in monthly budget plan. If agreement is terminated for any reason, customer agrees to pay total cap fee within 30 days from the date of termination.
   
   
9. This contract shall not be transferred or assigned by customer in whole or in part, directly or indirectly. Terms are valid from September 1, 2024 through May 31, 2025. Oil delivered outside this time period quantity specified shall be billed at our current prices on the date of delivery. Customer agrees to our normal credit terms which are net 30 days from the date of services rendered.
   
   
10. Company shall not be held liable for failure to perform its obligations under this agreement due to any government authority related to supply or price, or any reason, market conditions, any natural phenomenon, strike, embargo, disaster, or act of God, which may interrupt, limit, or halt the supply of fuel, temporarily or permanently. No claim shall be made under this contract for special or consequential damages as a result of entering into this contract.
    
    
11. If a customer commits a breach during the contract term, the customer will be responsible for paying the difference between the contract price and our current retail price on any unused gallons, plus a $300 termination fee. This serves as authorization to deduct such penalty and fee directly from your credit balance.
